Distance Sales Agreement

This Distance Sales Agreement ('Agreement') is made in accordance with the Law on Consumer Protection No. 6502 and the Distance Contracts Regulation of the Republic of Türkiye. It governs the purchase of tourism and travel services offered via this website.

1) Parties

Buyer / Customer

The natural or legal person who books and purchases a tour or travel service through this website ('Buyer'). The Buyer is responsible for providing accurate and complete information during booking.

2) Definitions

  • Law: Law on Consumer Protection No. 6502.
  • Regulation: Distance Contracts Regulation.
  • Service(s): Tourism and travel services including, but not limited to balloon flights, daily tours, private tours, private transfers, guided excursions, cultural activities, and related services.
  • Website: The Seller's online booking website.

3) Subject of the Agreement

This Agreement governs the electronic sale and delivery/performance of Services purchased by the Buyer via the Website. All bookings, payments, and related transactions are subject to this Agreement.

4) Service description and price

  • Service details (type, date, duration, inclusions/exclusions, pickup info where applicable) are shown on the booking page before confirmation.
  • Prices are shown in the currency available on checkout (e.g., TRY/EUR/USD/GBP). The currency selected at checkout determines the final payable amount.
  • Prices may be updated before booking is confirmed; confirmed bookings are not affected by later changes.
  • Taxes/fees are included or excluded as stated on the booking page. If any mandatory additional fee exists, it will be shown before confirmation.

5) Payment and confirmation

  • Payment is typically collected at the time of booking unless an explicit written deferred-payment arrangement is provided by the Seller.
  • Accepted payment methods may include credit/debit cards and, where offered, bank transfer. Available methods are shown during checkout.
  • After successful payment, the Buyer receives an electronic booking confirmation and/or voucher by email. Delivery of this confirmation/voucher constitutes the Seller's electronic delivery for the purpose of this Agreement.

6) Right of withdrawal and cancellations

Under the Distance Contracts Regulation, the statutory right of withdrawal may not apply to services related to accommodation, transportation, catering, and leisure activities that must be performed on a specific date or within a specific period.

Nevertheless, the Seller may offer a flexible cancellation/refund policy as a commercial courtesy. The applicable cancellation rules for your purchase are the ones shown at booking and/or published on our Cancellation Policy.

  • No-shows / late arrivals: May be treated as non-refundable unless stated otherwise.
  • Refund timing: If a refund is approved, it is processed to the original payment method within a reasonable timeframe. Banking timelines may vary.

7) Changes, rescheduling, and force majeure

The Seller may make reasonable changes to itineraries, pickup times, routes, or operational details where necessary for safety, weather, operational requirements, or force majeure (e.g., adverse weather, natural disasters, aviation restrictions, government actions).

If the booked Service cannot be provided due to such reasons, the Buyer may be offered (where applicable): rescheduling to another available date, an exchange for a service of similar value, or a refund pursuant to the applicable cancellation terms.

8) Buyer's responsibilities

  • Review booking details (date, meeting/pickup time & location, inclusions) before the service date.
  • Arrive on time. Missed departures may be treated as no-shows.
  • Follow safety instructions from pilots, guides, drivers, and staff.
  • Ensure personal suitability/health for activities (e.g., ballooning, ATV, hiking). If a medical condition may be relevant, the Buyer should consult a professional before participation.
  • The Buyer is responsible for personal belongings; the Seller is not liable for loss due to Buyer negligence.

9) Data protection and privacy

Personal data is processed in accordance with KVKK No. 6698 and, where applicable, GDPR. For details, please review our Privacy Policy.

10) Governing law and dispute resolution

This Agreement is governed by the laws of the Republic of Türkiye. Disputes may be submitted to the relevant Consumer Arbitration Committee or Consumer Court in accordance with the applicable monetary limits and rules of jurisdiction under Turkish consumer law.

11) Effectiveness and acceptance (electronic contract)

By clicking 'Confirm Booking', 'Complete Reservation', or a similar confirmation button during checkout, the Buyer acknowledges that they have read, understood, and accepted this Agreement electronically. This Agreement is deemed concluded at the time of electronic acceptance and is legally binding.

The Seller may store a copy of this Agreement and the booking transaction records to demonstrate compliance and to manage after-sales support, disputes, and legal obligations.
