These Terms govern the use of the website and services provided by Elite Travel Agency Cappadocia. By accessing our website, making a reservation,
or using our services, you acknowledge that you have read, understood, and agreed to be bound by these Terms, our
Privacy Policy and our Cancellation & Refund Policy. These Terms are intended to comply with
Turkish Consumer Protection Law No. 6502, the Distance Sales Contracts Regulation, Personal Data Protection Law No. 6698 (KVKK),
and applicable tourism legislation.

2) Scope of services

We provide travel-related services including tours, activities, transportation services, accommodation arrangements (where applicable), travel consulting, and related tourism services. Services may be provided directly by Elite Travel Agency Cappadocia or through independent third-party suppliers.

3) Definitions

  • Lead customer: The person who places the booking and accepts these Terms on behalf of all participants in the booking.
  • Service start time: The scheduled start time shown on your booking confirmation (and/or pickup time if pickup is provided).
  • No-show: Failure to attend the pickup or the service start without prior written notice, or arriving too late to participate.
  • Supplier: Any independent third-party provider delivering part of the service (e.g., balloon operator, transportation company, activity provider, hotel).

4) Use of the website

Users agree to use this website only for lawful purposes. Any misuse, including but not limited to fraudulent bookings, unauthorized access, attempts to disrupt service, or actions that may damage the website or its content, is strictly prohibited. We reserve the right to restrict or terminate access in case of misuse or suspected fraud.

5) Bookings, reservations, and confirmation

  • All bookings are subject to availability and confirmation.
  • The lead customer must be at least 18 years old and confirms they have authority to accept these Terms for all participants.
  • The customer is responsible for providing accurate, complete, and up-to-date information during the booking process.
  • A booking is confirmed only after successful payment and a written confirmation is issued (e.g., email confirmation / voucher).
  • We may cancel or refuse bookings due to incorrect information, suspected fraud, safety, capacity limits, or circumstances beyond reasonable control. Where applicable, we will offer alternatives or a refund in line with our policies.

6) Prices and payments

Prices are displayed in the applicable currency and may include or exclude taxes, fees, or service charges unless otherwise stated. Prices may change without prior notice; however, confirmed bookings are not affected. Payments must be completed according to the conditions specified during the booking process. Card payments are processed through secure, PCI-DSS compliant gateways; we do not store full card details on our servers.

7) Cancellation, changes, and refunds

Our Cancellation & Refund Policy applies and is incorporated into these Terms by reference. Key rules (unless your activity page or confirmation states otherwise):

  • Hot Air Balloon Flights: Free cancellation up to 48 hours before the service start time. Cancellations within 48 hours and no-shows are non-refundable.
  • Tours & Activities (Non-balloon): Free cancellation up to 48 hours before the tour start time. Cancellations within 48 hours and no-shows are non-refundable.
  • Transfers: Free cancellation up to 24 hours before pickup time. Cancellations within 24 hours and no-shows are non-refundable.
  • Weather / safety cancellations: Where a service is cancelled due to safety or weather conditions (especially balloon flights), you will be offered rescheduling or a refund depending on feasibility and supplier rules.
  • Refund timing: Approved refunds are processed to the original payment method and we aim to process them within 14 days. Banks/payment providers may take additional time to reflect the refund.
  • Payment processing fees: Some payment providers and/or suppliers may charge non-refundable transaction fees. If such fees are not returned to us, we may deduct the actual non-refundable fee from your refund (up to 3%), where applicable.

8) Changes to services

We reserve the right to modify itineraries, schedules, pickup times, meeting points, routes, prices, or service details when necessary due to operational requirements, safety concerns, weather conditions, permits, supplier constraints, or force majeure events. If a significant change occurs, we will offer a reasonable alternative, rescheduling, or a refund where applicable.

9) Customer responsibilities

  • Ensuring possession of valid travel documents (passport, visa, etc.) where applicable.
  • Ensuring you are medically fit to participate and following safety instructions.
  • Arriving on time for tours, transfers, and scheduled services.
  • Complying with local laws, regulations, and tour rules.

We are not responsible for losses or disruptions caused by a customer's failure to meet these obligations.

10) Third-party services

Certain services may be provided by independent third-party suppliers such as balloon operators, hotels, transportation companies, or activity providers. Where applicable, Elite Travel Agency Cappadocia may act as an intermediary and is not responsible for the acts or omissions of such suppliers beyond what is required by law. Supplier rules may apply to operational decisions (capacity, safety, rescheduling) and may affect refund eligibility.

11) Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, or consequential damages. Our liability is limited to direct damages caused by proven negligence, where required by law. Personal belongings remain the participant's responsibility.

12) Force majeure

We shall not be liable for failure or delay in the performance of obligations due to events beyond reasonable control, including but not limited to natural disasters, pandemics, strikes, governmental actions, aviation authority decisions, or transportation disruptions. Remedies (reschedule/refund/alternative) depend on feasibility and supplier policies.

13) Intellectual property

All content on this website, including text, images, graphics, logos, designs, and trademarks, is owned by or licensed to Elite Travel Agency Cappadocia and may not be copied, reproduced, distributed, or used without prior written consent.

14) Privacy and data protection

The collection and processing of personal data are governed by our Privacy Policy, which forms an integral part of these Terms.

15) Right of withdrawal

Our services are typically provided on a specific date and/or within a specific period (e.g., tours, activities, balloon flights, transfers). Under Turkish law and the Distance Sales Contracts Regulation, the right of withdrawal may not apply to certain leisure services scheduled for a specific date or period.

16) Governing law and jurisdiction

These Terms are governed by and construed in accordance with the laws of the Republic of Türkiye. Disputes fall under the jurisdiction of the relevant Turkish courts and consumer dispute resolution bodies, subject to applicable legal thresholds.

17) Amendments

We may amend or update these Terms at any time. Any changes become effective upon publication on this page. Continued use of the website or services after changes constitutes acceptance of the updated Terms.
